Terms of Service
Terms of use of the Evidiq application, including data processing terms
Effective from 10 September 2026
These terms govern the use of the Evidiq application (app.evidiq.cz) operated by Techcrowd s.r.o., Company ID 17846218, registered office Pod Nádražím 1204, 286 01 Čáslav, Czech Republic (the "Provider"). The user is the natural or legal person who creates an account (the "User"). The service is intended for businesses and care providers, not consumers.
1. The service
Evidiq is a web application for client and patient documentation: client records, visit notes, calendar, voice dictation and AI-drafted records, data export. The features of each plan are listed in the pricing section on evidiq.cz.
The Provider may develop the service and change its appearance or individual features. Material reductions of paid-plan features are announced at least 30 days in advance.
2. Account and registration
- The account is tied to an e-mail address; the User is responsible for keeping credentials confidential and for all activity under the account.
- The User provides accurate information and keeps it up to date.
- One account is intended for one person. The Clinic plan allows several users within one practice to the extent agreed at activation.
3. Plans, payments and cancellation
- The Free plan is free of charge and requires no payment card. A new account receives a 14-day trial of the Professional plan without a card; afterwards it switches to the Free plan automatically unless the User chooses a subscription. Paid plans are billed monthly in advance through the Stripe payment gateway.
- Prices are stated excluding VAT. Invoices are sent electronically to the account e-mail.
- Subscriptions renew automatically. The User may cancel at any time in account settings; the service then runs until the end of the paid period. No refund is provided for the unused part of a period unless required by law.
- AI features are included in paid plans as a monthly AI processing credit stated in the pricing. Once used up, additional credit can be purchased or AI features paused until the next period; all other features remain available.
- The Provider may change prices with at least 30 days' notice; the change applies from the next billing period.
4. User obligations and content
- The User is responsible for the content entered into the application and for having an appropriate legal basis to process it, including duties towards their clients (information duty, any consents, healthcare regulation).
- The User must not use the service unlawfully, compromise its security or availability, or share access with unauthorised persons.
- Evidiq is a documentation tool, not a medical device; it does not replace the User's professional judgement.
5. Artificial intelligence
Speech transcription and AI-drafted records are assistive features. Outputs may contain errors; the User reviews them before saving and is responsible for their final form. The Provider does not guarantee a specific transcription accuracy.
6. Processing of client data (Art. 28 GDPR)
With respect to client and patient data entered into the application, the User is the controller and the Provider the processor. This section constitutes the data processing agreement under Art. 28(3) GDPR. On request the Provider will sign a separate data processing agreement of identical content.
- Subject matter and duration: provision of the service for the lifetime of the account. Nature and purpose: storage, display, backup, transcription and summarisation of records on the User's instructions. Categories of data: identification, contact and health data of clients. Data subjects: the User's clients and patients.
- The Provider processes data only on the User's documented instructions (given by using the application's features), ensures confidentiality of persons with access, and implements the technical and organisational measures described in the Privacy Policy.
- The User grants general authorisation to engage the sub-processors listed in the Privacy Policy (hosting, AI transcription and summarisation, e-mail, payments). The Provider gives at least 30 days' notice of intended changes; the User may object and terminate the account.
- The Provider assists the User with data subject rights and with obligations under Art. 32–36 GDPR, notifies the User of personal data breaches without undue delay after becoming aware, and provides information necessary to demonstrate compliance.
- After termination the Provider enables export of all data and then deletes it within 30 days, unless EU or Member State law requires storage.
7. Availability, support and warranty
- The Provider strives for continuous availability; planned maintenance is announced in advance. Guaranteed availability and response times can be agreed in a separate service agreement.
- Defects are reported to info@techcrowd.cz; the Provider remedies them within a reasonable time according to severity.
- Data is backed up regularly; the User can export their own data at any time.
8. Liability
The Provider is liable for damage caused by breach of its obligations up to the amount paid by the User in the preceding 12 months; this does not apply to damage caused intentionally or by gross negligence, nor where the law does not permit limitation. The Provider is not liable for content entered by the User or for decisions made on the basis of AI outputs.
9. Termination
- The User may cancel the account at any time in the application settings.
- The Provider may suspend or terminate the account upon material breach of these terms, in particular misuse of the service or payment default exceeding 30 days, after prior notice.
- After termination the User has 30 days to export data; data is then deleted in accordance with section 6.
10. Final provisions
These terms are governed by the laws of the Czech Republic. The Provider may amend them with at least 30 days' e-mail notice; a User who disagrees may cancel the account before the change takes effect. The Privacy Policy forms an integral part of these terms.
